Welcome to dogdelitreats.com. This website is operated by DOGDELI, headquartered in Hallandale Beach, Florida. Throughout the site, the terms “we”, "us" and “our” refer to DOGDELI. By accessing our website, purchasing our all-natural dog treats, or enrolling in our auto-ship subscription program, you agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”).

 1. ONLINE STORE TERMS & PRODUCT SAFETY

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence.

* Perishable Pet Consumables: Our treats are handcrafted, all-natural animal food products. While we maintain the highest manufacturing and ingredient standards, pet owners are responsible for reviewing ingredient lists for potential allergens or dietary sensitivities unique to their pets.

* Disclaimer:  We are not liable for individual adverse dietary reactions or veterinary bills resulting from the consumption of our products unless caused by proven gross negligence on our part.

2. APPSTLE AUTOMATED SUBSCRIPTION BUNDLES

DOGDELI offers a convenient Subscribe & Save program powered by Appstle Subscription. By enrolling, you authorize recurring automatic charges to your selected payment method at the frequency chosen.

* Online Cancellation Rights (Florida ARL Compliance):** You may modify, pause, or cancel your recurring subscription at any time. In compliance with Florida law, you may cancel your subscription directly online through your secure customer portal in the same digital manner you enrolled, without needing to contact support.

* Cancellation Deadline: To avoid being billed for your next scheduled order, you must execute your cancellation inside the portal at least 48 hours prior to your next scheduled billing date.

* Late Cancellations:** Subscription cancellations processed less than 48 hours before the renewal date cannot be halted, and that final cycle will be fulfilled and shipped as normal.

 3. REFUND, RETURNS & SANITATION POLICY

To maintain maximum sanitary and safety standards for live animals, DOGDELI maintains a strict NO RETURNS and NO EXCHANGES policy on all consumable pet food products.

* We cannot accept return shipments of opened or unopened dog treat bags due to contamination safety risks.

* Satisfaction Discretion: If your dog completely refuses a treat or you are deeply unsatisfied with your experience, contact our customer support team. At our sole discretion, we may issue an account store credit or replacement, but a physical return of items is never authorized.

4. SHIPPING, DAMAGE CLAIMS & TEMPERATURE LIABILITY

Operating out of Florida, we expert-pack treats to withstand transit environment conditions. However, once a package is handed over to a third-party carrier, the risk of loss passes to the buyer.

* Transit Defect Reporting: Upon delivery, you have exactly five (5) calendar days to inspect the treats. If a package arrives severely damaged, compromised, or melted, you must email support@dogdelitreats.com within this 5-day window.

* Evidence Requirements: All transit damage claims must include clear photographic evidence of both the shipping container and the damaged treat packaging to qualify for a free replacement.

 5. WIRELESS & TELECOMMUNICATIONS MARKETING TERMS (TCPA & FTSA)

If you explicitly opt-in to our mobile messaging program via checkout or promotional forms (using platforms like Klaviyo, Mailchimp, or Ctx WhatsApp), you agree to the following:

* Consent: You grant express written consent to receive automated promotional and transactional messages at the number provided. Consent is not a condition of purchase.

* Opt-Out: You can opt-out of text marketing at any time by replying STOP to any text received, or responding STOP in your WhatsApp window.

* Data Privacy Segregation: Required shipping phone numbers collected under checkout rules are strictly kept isolated from promotional text databases unless marketing boxes are voluntarily checked.

6. USER-GENERATED CONTENT, REVIEWS, & DMCA SAFE HARBOR

When you submit a product review, photo, or testimonial via Judge.me Reviews, Revit, or our social media extensions, you grant DOGDELI a non-exclusive, royalty-free, perpetual license to use, display, and distribute that content for marketing purposes.

• Content Authenticity: You represent that you own all rights to any photographs or media uploaded to our platform.
• Copyright Takedown Requests (DMCA): If you believe any user-uploaded content on our platform infringes upon your copyright, please submit an official takedown request detailing the specific link to support@dogdelitreats.com for immediate remediation.

 

 7. INTELLECTUAL PROPERTY RIGHTS

The DOGDELI logo, unique treat product photography, recipe names, website graphics, and custom text copy are the exclusive intellectual property of DOGDELI. Any unauthorized duplication, redistribution, or framing of our materials for commercial use is strictly prohibited.

8. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, DOGDELI and its employees shall not be liable for any indirect, incidental, punitive, or consequential damages arising from your use of the site or consumption of the products. Our total liability to you for any claim arising out of your purchase shall not exceed the exact dollar amount paid by you for the specific products in dispute.

9. DISPUTE RESOLUTION: MANDATORY BINDING ARBITRATION & CLASS ACTION WAIVER

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

* Mandatory Arbitration: You and DOGDELI agree that any legal dispute, claim, or controversy arising out of or relating to these Terms, purchases, website accessibility, or marketing communications shall be settled exclusively through binding, individual arbitration rather than in a court of law.

* Class Action Waiver: YOU AND DOGDELI AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims or preside over any form of a class proceeding.

10. GOVERNING LAW & LEGAL JURISDICTION

These Terms of Service and any separate agreements whereby we provide you products or services shall be governed by, interpreted, and enforced in accordance with the laws of the State of Florida, without regard to conflict of law principles. Any arbitration hearings or permitted legal actions must take place exclusively within Broward County, Florida.

 

 11. WEBSITE ACCESSIBILITY & GOOD-FAITH REMEDIATION

DOGDELI is committed to digital inclusion and ensuring that our website, dogdelitreats.com, is accessible to individuals with disabilities. We continually work to align our storefront with relevant Web Content Accessibility Guidelines (WCAG) standards.

* Notice of Accessibility Barriers: If you encounter any accessibility barriers, text contrast issues, or screen-reader errors anywhere on our online store, you agree to notify us immediately before taking any formal legal action.

* Mandatory Cure Period: You must submit a detailed description of the specific page URL and accessibility issue to support@dogdelitreats.com. Following receipt of your notice, DOGDELI shall have exactly thirty (30) calendar days to review, investigate, and remediate the reported code or layout issue.

* Pre-requisite to Action: Agreeing to provide this 30-day "right to cure" window is a mandatory prerequisite. You expressly waive the right to initiate an arbitration proceeding or legal claim regarding website accessibility until this 30-day remediation period has fully elapsed without a good-faith resolution.
